Terms and Conditions

General & Parties
These Terms and Conditions apply to all purchases of products, digital files, and engineering services from Smi3D AS via smi3d.no.

Prices: All prices are displayed in NOK (or selected currency) and specify whether VAT/MVA is included or excluded at checkout.
Taxes: Orders shipped outside of Norway may be subject to local import duties, taxes, and customs clearance fees. These charges are the sole responsibility of the buyer.
Payment Methods: We accept payments through secure third-party payment providers (e.g., Stripe, Credit/Debit cards). Payment is charged at the time of order placement.

Physical Goods: In-stock standard products are dispatched within 1–3 business days. Lead times for made-to-order parts will be specified during quotation or checkout.
Digital Downloads (STL/CAD Files): Digital files are delivered automatically via download link upon successful payment completion.

Right of Withdrawal & Cancellation
In accordance with the Norwegian Right of Withdrawal Act (Angrerettloven):

Standard Physical Items: Private consumers (B2C) have a 14-day right of withdrawal from the day the goods are received. Items must be returned unused, undamaged, and in original packaging. The buyer covers return shipping costs.
Digital Products (STL / CAD Data): The right of withdrawal lapses immediately once the digital download has commenced, jf. Angrerettloven § 22 n.
Custom Engineering & Made-to-Order Manufacturing: Custom CAD design, 3D scanning, and physical parts manufactured to customer specifications are exempt from the right of withdrawal once production or design work has started, jf. Angrerettloven § 22 e.

Ownership: All 3D scan datasets, CAD models, meshes, and digital deliverables remain the intellectual property of Smi3D AS.
Permitted Use (Standard License): Digital datasets are provided under a non-exclusive, non-transferable license. The buyer is permitted to use the scan data for development, packaging, design, and commercial manufacturing of physical aftermarket parts and hardware.
Restrictions: Reselling, sublicensing, sharing, re-uploading, or redistributing the digital files—whether in raw format (.OBJ, .STL, .PLY) or converted/decimated CAD formats (.STEP, .IGES, etc.)—is strictly prohibited. You may not sell or distribute 3D scan files or digital replicas of the scanned asset itself.
EULA: Specific digital products may include an End-User License Agreement (.DOC/.PDF) inside the archive detailing technical usage rights for that specific asset. By downloading the file, you agree to these attached terms.

Intended Use: Many products engineered by Smi3D AS are designed for off-road, motorsport, or specialized custom use.
Customer Responsibility: The buyer is responsible for inspecting parts for fitment, structural integrity, and suitability before installation. Smi3D AS is not liable for damages, personal injuries, or secondary mechanical failures resulting from improper installation or extreme use.

Warranty & Claims (Reklamasjon)
If a physical product is defective or damaged upon arrival, contact orders@smi3d.no immediately with order details and photos. Claims are handled in accordance with the Norwegian Consumer Sales Act (Forbrukerkjøpsloven) and Sale of Goods Act (Kjøpsloven).
Governing Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of Norway. Any disputes shall be subject to the exclusive jurisdiction of the district court of Søndre Østfold tingrett, Norway.
